Terms and Conditions of Pilatesbarre

Welcome to Pilatesbarre located in Rhodes, Lidcombe and Sydney, Australia. These Terms and Conditions ("Terms") govern your use of our studio, services, and products. By using our studio, you agree to these Terms. Please read them carefully.

Studio Use

  1. You must be at least 18 years of age to use our studio.

  2. You must wear appropriate clothing and grip socks while using our studio.

  3. You must follow all safety instructions and guidelines provided by our instructors.

  4. You must not engage in any behaviour that may cause harm or injury to yourself, other customers, or our staff.

  5. The use of equipment within the studio is only permitted under the guidance of a certified instructor during reserved class times.

Services and Products

  1. We offer a variety of Pilates classes and products. Please refer to our website for a full list of our services and products.

  2. We reserve the right to change our services and products at any time without prior notice.

  3. Payment for our services and products is required prior to use.

Liability and Indemnification

  1. We are not responsible for any injury, loss, or damage that may occur while using our studio, services, or products.

  2. You agree to indemnify us against any claims or damages arising from your use of our studio, services, or products.

Termination

We reserve the right to terminate your use of our studio, services, or products if you violate these Terms or engage in any behaviour that we deem inappropriate.

Intellectual Property

  1. All intellectual property related to our studio, services, and products is owned by us.

  2. You must not reproduce, modify, sell, transfer, or commercially use any of our intellectual property without our prior consent.

Membership (weekly, monthly)

  1. Cancellation policy

    Once a class is booked, there is no option for early cancellation. Therefore, members are requested to be cautious when booking classes to avoid any inconvenience.

  2. No-Show/Cancellation Policy

    Members are requested to cancel their booked classes at least 24 hours in advance. Failure to attend a booked class without prior notice will be considered a "no-show." If a member's no-show or cancellation rate exceeds 50%, they will not be eligible for the next membership registration.

  3. Freezing Policy

    Memberships cannot be frozen during a one-week or one-month membership period. However, members may opt not to book classes for a specific period.

  4. Refund Policy

    Members who wish to receive a refund for their membership must submit a refund request within 24 hours of purchase.

  5. Membership Transfer

    Membership cannot be transferred to another person. Any attempt to do so may result in the cancellation of the membership without refund.

  6. Membership Usage

    Membership must be utilized within one week, month or year of the first class, including the initial class day. Failure to use the membership within the specified period will result in its expiration.

Opening hour

Our studio's opening hours are from 8:00 am to 10:00 pm, seven days a week, subject to change according to session bookings and start times. The studio will be closed on public holidays. All sessions will commence strictly on time and run for 50 minutes. Sessions will not run past the set session times for late arrivals.

Package expiry

Our packages have an expiry period, as listed below. Please be advised that packages must be used within the appropriate periods, otherwise sessions will expire. Public holidays do not count towards the expiry period.

  • 10 session packages: 12 weeks from 1st session

  • Monthly pass: 1 month from the 1st session

  • Weekly pass: 1 week from the 1st session

  • Single session: 1 month from the purchase date

Refund & Transfer

Changing class hours or instructors is not a reason for a refund. All services and packages will not be refunded should members have a change of heart or dislike the service. Members will have the option to transfer their package to another person. The limit for transferring a package is one client per person. When a refund of 10 packages is made in a single session, the amount refunded will exclude 10% of the remaining amount.

Package expiry extension

Members can extend their package for a maximum of 6 months in case of pregnancy. Doctor’s Certificate must be provided. In case you need to extend the expiry due to medical issues (e.g. surgery/injury), medical certificate with specified period must be submitted. Members traveling overseas can extend their passes up to maximum 4 weeks. Supporting document must be submitted. Monthly/Weekly passes are strictly non-extendable.

Booking

Changes and cancellations must be made 24 hours prior to booking times to avoid loss of session. Cancellations made within 24 hours of booking times will be counted as a loss of session. No exceptions will be made.

All members are only allowed to attend classes during their reserved times. Attending classes outside of your reservation is not possible. Participating in a different class outside of your reserved time constitutes a reschedule. If rescheduling occurs within 24 hours of the originally reserved class, the initial reservation will be considered late-cancelled. Accordingly, reserving the changed time slot requires a separate fee applied.

In the event that only one member attends a 2:1 session, both members will still be charged. To avoid the loss of a session, early cancellation notice should be given 24 hours in advance, or one member should convert the session to 1:1 private at the cost of a single session.

In the event that only 1 member or less attends a group session, PilatesBarre has the right to cancel or change sessions. Booking window is open for 2 weeks ahead. Continued cancellation of 3 times in a row may forfeit your reserved fixed session time.

Class attend

Late arrivals of 20 minutes or more will not be able to attend sessions and will result in the loss of the session. Sessions can only be used by members of purchase. In the event that a designated instructor is unable to attend, a replacement instructor may be provided. Pilates socks must be worn when attending sessions. Non-compliance will result in the loss of the session. Please be advised that the entire premises are monitored by CCTV (excluding bathrooms).

Pets are not allowed in the studio.

Babies/ young children are not allowed to be in the class due to safety requirements. Should an incident occur regarding unsupervised children in the class, PilatesBarre will not be held liable.

Pre-natal

Pre-natal class is only available as in 1:1 private and begin from second trimester with doctor’s approval. Our group classes are not suitable for prenatal.

Medical Condition

All members are required to provide their medical condition/medical history to Pilates Barre before attending any sessions. Should an incident regarding this occur, and Pilates Barre was not advised before commencement, Pilates Barre will not be held liable. Pilates Barre will not be liable for any incidents regarding negligent behavior from members. Pilates Barre will not be liable for loss/damage to personal belongings.

Our Pilates Barre group classes may not be suitable if you have any medical conditions. If you do, we strongly recommend private sessions to avoid unnecessary risks. We may require relevant documents, such as a doctor’s referral letter. Please note that our instructors cannot diagnose your condition; we are here to assist you in exercising within a safe range. The ability to participate in group classes may vary depending on the severity of the condition.

Privacy

We strive to protect your personal information to the best of our ability. For further details on our privacy protection policy, please refer to our Privacy Policy.

Please be advised that the entire premises are monitored by CCTV (excluding bathrooms and change rooms) for the purpose of ensuring security. CCTV recordings can be accessed only by authorised staff.

You must not photograph/record other members or instructors during the class without their express consent. Failure to do so is breach of our terms and conditions and you may be asked to leave.

Other Provisions

These terms and conditions may be modified at any time. The revised terms and conditions will take effect immediately from the date of their publication on our website. Matters not specified in these terms and conditions will be determined in accordance with relevant laws and regulations.

Governing Law and Jurisdiction

These Terms are governed by the laws of Australia, and any disputes related to these Terms must be resolved in the courts of Sydney, Australia.
