1. General Terms and Conditions

Pilatesbarre operates studios in Sydney CBD, Rhodes, Lidcombe, Chatswood and Burwood Australia. These Terms and Conditions (“Terms”) govern the use of our studios, services, and products. By accessing or using our facilities, you acknowledge that you have read, understood, and agree to be bound by these Terms. Please review them carefully.

1.1 Studio Usage

1. All members and guests must comply with safety instructions provided by certified instructors. Non-compliance may result in the suspension of studio privileges.

2. Appropriate attire, including grip socks, is mandatory to ensure safety and hygiene. Failure to adhere to this may result in restricted access to services.

3. Members and guests must refrain from any behavior that could cause harm or injury to themselves, other members, or staff. Violations may lead to immediate suspension or expulsion.

4. The use of studio equipment is allowed only during reserved class times and must be under the supervision of a certified instructor. Members are financially responsible for any damage caused by improper use.

5. Pets or other animals are strictly prohibited within the studio premises to maintain safety and hygiene standards.

1.2 Facility Use

1. Members and guests may use the lockers and other facilities before and after sessions. Pilatesbarre is not responsible for lost or stolen personal belongings.

2. CCTV monitoring is conducted throughout the studio for security purposes, excluding restrooms and changing rooms.

1.3 Services and Products

1. Pilatesbarre offers various services, including individual and group Pilates sessions, workshops, and training programs.

2. Service schedules are subject to change without prior notice. Any updates will be communicated through our website and mobile application.

3. All services and products must be paid for in advance to secure reservations.

4. Products purchased within the studio are non-refundable, except for exchanges due to defects within 30 days of purchase, provided the product is unused and the original receipt is presented.

5. Pilatesbarre may modify, withdraw, or discontinue the sale of any service or Membership product from time to time.

1.4 Health and Safety

1. Members are required to disclose their health conditions and medical history before participating in any studio sessions. Medical clearance may be necessary in certain circumstances.

2. Members must adhere to the guidance of certified instructors when using equipment. The studio is not liable for injuries resulting from improper use or excessive exercise.

3. Prenatal and postnatal Pilates sessions are offered exclusively as 1:1 private sessions for safety reasons.

1.5 Liability and Indemnification

1. Pilatesbarre is not liable for any injuries, losses, or damages incurred during the use of its studios, services, or products.

2. Members agree to indemnify and hold harmless Pilatesbarre from any claims or damages arising from their use of the studios, services, or products.

1.6 Intellectual Property

1. All intellectual property rights related to Pilatesbarre studios, services, and products are owned by Pilatesbarre. Unauthorized reproduction, modification, or commercial exploitation is prohibited.

1.7 Privacy Protection

1. Pilatesbarre is committed to protecting members’ personal information in accordance with our Privacy Policy, which can be reviewed on our website.

2. Members must obtain explicit consent before photographing or recording other members or instructors during sessions.

1.8 Modifications and Governing Law

1. These Terms may be updated periodically. Any changes will become effective immediately upon posting on our website.

2. These Terms are governed by the laws of Australia, and any disputes will be resolved in the courts of Sydney, Australia.

1.9 Dispute Resolution

1. In the event of a dispute, members and Pilatesbarre agree to first attempt resolution through amicable negotiation.

2. If a resolution cannot be reached, the dispute will be settled in the jurisdiction of Sydney, Australia.

2. Membership Terms and Conditions

2.1 Membership Overview

1. Membership tiers and availability may vary by studio location and may be amended, withdrawn, or discontinued from time to time.

2. Membership fees are listed on our website and are subject to change. Please refer to our Membership Pricing Page for the most current rates.

3. Pilatesbarre may discontinue the sale or renewal of a particular Membership tier at a specific studio location.

2.2 Membership Tiers

Premium Membership

• Benefits: Unlimited access to all group classes. Additional perks include a 20% discount on retail purchases and a 50% discount on the Pilates instructor course (available only with a 1-year contract).

• Extension: Travel-related extensions are available for up to 4 weeks, and medical extensions for up to 2 weeks, both free of charge. For additional extension beyond these limits, Premium members may purchase up to an additional 4 weeks at $50 per 2-week period. (Refer to 2.4 for more details)

• Termination: No refunds will be issued for any remaining balance on the contract.

Standard Membership

• Benefits: Unlimited access to all group classes. Additional perks include a 20% discount on retail purchases.

• Extension: Travel-related extensions are available for up to 4 weeks, and medical extensions for up to 2 weeks, both free of charge. (Refer to 2.4 for more details)

• Termination: No refunds will be issued for any remaining balance on the contract.

Flex Membership

• Benefits: 8 group class sessions per month, with the ability to roll over up to 3 unused sessions to the following month. Additional perks include a 20% discount on retail purchases.

• Extension: Travel-related extensions are available for up to 4 weeks, and medical extensions for up to 2 weeks, both free of charge. (Refer to 2.4 for more details)

• Termination: No refunds will be issued for any remaining balance on the contract.

Location-Specific Memberships

• Certain Membership products may be offered only at specific studio locations and may be subject to location-specific terms.

• Pilatesbarre may modify, withdraw, or discontinue the sale of any location-specific Membership product at its discretion.

2.3 Booking and Cancellation Policy

1. All classes must be booked in advance through our mobile app.

2. Cancellations must be made at least 24 hours before the scheduled class. Failure to cancel within this window will result in a $25 late cancellation fee.

3. No-shows will incur a $30 fee.

2.4 Membership Extension

1. Extension for All Members: Extensions for medical reasons may be granted for up to 2 weeks with valid documentation. Travel-related extensions are capped at 4 weeks, with proof of travel required.

2. Premium Member Extensions: Premium members can purchase additional extension time beyond the standard limits. Extensions are available at $50 per 2-week period, up to a maximum of 4 weeks.

2.5 Refund and Transfer Policy

1. Refunds: Membership fees are generally non-refundable once a Membership has commenced, except where a refund, cancellation, or other remedy is required under the Australian Consumer Law or other applicable laws.

*All package group class refunds will be calculated based on the single-session rate for the classes used. The remaining balance will be refunded after deducting 10% as a processing fee.

*Products purchased on promotion are non-refundable unless otherwise required by law.

2. Transfers: Memberships are non-transferable and cannot be assigned to another individual.

2.6 Auto-Payment and Cancellation

1. Memberships may be subject to automatic renewal at the end of the applicable Membership term, as specified at the time of purchase.

2. Where automatic renewal applies, members are responsible for cancelling their Membership before the renewal date if they do not wish to continue. Failure to cancel will result in the Membership auto-renewing and the associated fees being charged.

3. Pilatesbarre may discontinue the sale or renewal of a particular Membership product or Membership tier at a specific studio location.

4. Where a Membership product is discontinued, the discontinued Membership product may no longer be available for renewal after the expiry of the member's current Membership term. Where applicable, the member will be notified before the end of their current Membership term that their Membership will expire on the stated expiry date and will not automatically renew.

5. Members will not be charged for a further Membership term after their existing Membership expires where Pilatesbarre has notified the member that the Membership will not renew.

2.7 Additional Terms

1. Pilatesbarre reserves the right to modify these terms and conditions at any time. Updated terms will be posted on our website and will take immediate effect.

2. These terms are governed by the laws of Australia, and any disputes will be resolved in the courts of Sydney, Australia.

3. Promotion Terms and Conditions

3.1 General Promotion Guidelines

1. Non-Combination Policy: Promotions cannot be combined with any other offers, discounts, or promotions unless explicitly stated.

2. No Refunds or Exchanges: Promotions are non-refundable and non-transferable. Once a promotion is purchased or redeemed, it cannot be exchanged for other services, products, or cash.

3. Expiration Dates:

• All promotions have an expiration date, and services or products must be used within the promotional period. No extensions will be granted unless specified in writing.

• Trial sessions must be used within 14 days of purchase, unless otherwise stated.

4. Availability: All promotions are subject to availability and may be withdrawn or changed without prior notice.

3.2 Redemption Policy

1. Promotions must be redeemed in accordance with the specified terms and conditions outlined at the time of purchase or announcement.

2. Proof of eligibility, such as promotional codes or email confirmations, may be required at the time of redemption.

3.3 Booking and Cancellation

1. Classes or services booked under a promotion are subject to Pilatesbarre’s general booking and cancellation policies.

2. Late cancellations and no-shows may result in forfeiture of the promotional session without refund or rescheduling.

3.4 Liability

1. Pilatesbarre reserves the right to decline any promotion redemption that does not meet the outlined terms and conditions.

2. Pilatesbarre is not responsible for any typographical or communication errors regarding promotional details.

3.5 Modifications

1. Pilatesbarre reserves the right to modify or cancel any promotion at any time without prior notice.

2. Updated terms will be posted on our website and will take immediate effect.
